These Terms & Conditions (“Terms”) govern your access to and use of the website located at https://perseusloans.com and any related pages, applications, content, features, or services we control (collectively, the “Site”). “Perseus Financial Loans,” “Perseus Loans,” “we,” “us,” and “our” mean Perseus Investments LLC.
By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.
Financial Privacy (GLBA): If you apply for or obtain a consumer loan from us, certain information is governed by the Gramm-Leach-Bliley Act and our GLBA privacy notice (provided at application/closing and available on request). Where GLBA applies, it controls over these Terms for privacy matters.
1. Eligibility & Use of the Site
You must be at least 18 years old (or the age of majority in your state) and reside in the United States to use the Site. You agree to use the Site for lawful purposes and in accordance with these Terms.
2. No Guaranteed Offers; Product Availability
Any rates, terms, or product descriptions on the Site are for informational purposes only and are not a commitment to lend. Loan approval, amounts, APRs, fees, and timing are subject to creditworthiness, underwriting criteria, verification of information, applicable law, and availability in your state. We may decline to provide products or services at our discretion.
3. Application Information; Credit & Verification Authorization
By submitting an inquiry or application, you represent that all information you provide is true, accurate, and complete, and you authorize us (and our service providers or lending partners, if any) to:
- obtain consumer reports and credit information about you from credit bureaus at any time for underwriting, account review, servicing, or collection under the Fair Credit Reporting Act (FCRA);
- verify your identity, income, employment, bank account, and other information with third parties; and
- contact you as described in Section 7 (Communications).
If you connect payroll, bank, or other data sources, you direct those third parties to provide your information to us for the purposes described.
4. E-Sign Consent
We may provide disclosures, notices, agreements, and other communications electronically (“Electronic Communications”). By using the Site, you consent to receive Electronic Communications and to sign electronically in compliance with the E-SIGN Act and applicable state laws. You may withdraw consent or request paper copies by contacting us (fees may apply where permitted by law). Hardware/software requirements and additional details may be provided at the time of consent.
5. Account Registration & Security
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use or security breach. We may suspend or terminate access for any suspected violation of these Terms.
6. Intellectual Property & License
The Site, including its text, graphics, logos, icons, images, software, and other content (collectively, “Content”), is owned by us or our licensors and is protected by U.S. and international laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes.
You may not copy, distribute, modify, create derivative works, publicly perform, reverse engineer, or exploit the Site or Content except as expressly permitted in these Terms.
“Perseus Investments LLC,” “Perseus Financial Loans,” “Perseus Loans,” and associated logos are trademarks or service marks of Perseus Investments LLC. Other names may be trademarks of their respective owners. No license or right is granted by implication, estoppel, or otherwise.
7. Communications; Consent to Calls & Texts
By providing a phone number or email, you consent to our contacting you using any method, including calls, text messages (SMS/MMS), and emails, for application, servicing, collections, and marketing purposes where permitted by law. We (or our service providers) may use an autodialer, prerecorded, or artificial voice. Message and data rates may apply.
You may opt out of marketing texts at any time by replying STOP; reply HELP for help. Opting out of marketing does not affect non-marketing messages (e.g., account or transactional).
8. Prohibited Uses
You agree not to: (a) use the Site in violation of law or these Terms; (b) provide false, misleading, or incomplete information; (c) introduce malicious code; (d) attempt to gain unauthorized access to the Site or related systems; (e) use scraping, mining, spiders, robots, or similar data-gathering tools without our prior written consent; or (f) interfere with others’ use of the Site.
9. Third-Party Links & Services
The Site may link to third-party websites or services. We do not control and are not responsible for third-party content, products, services, or practices. Your use of third-party sites is at your own risk and subject to their terms and policies.
10. Educational Content Only; No Advice
Site content is provided for general informational purposes and is not legal, financial, tax, or other professional advice. Decisions regarding loans or finances should be based on your individual circumstances and, where appropriate, advice from qualified professionals.

12. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE. YOUR USE OF THE SITE IS AT YOUR OWN RISK.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL PERSEUS INVESTMENTS LLC, ITS AFFILIATES, OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED $100 OR THE AMOUNT YOU PAID (IF ANY) TO USE THE SITE IN THE 12 MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations; portions of this section may not apply to you.
14. Indemnification
You agree to defend, indemnify, and hold harmless Perseus Investments LLC and its affiliates, and their respective directors, officers, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms or your misuse of the Site.
15. Arbitration Agreement & Class-Action Waiver
PLEASE READ THIS SECTION CAREFULLY. It affects your rights.
a. Agreement to Arbitrate. Except for disputes that qualify for small-claims court, you and we agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Site will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act (FAA) governs the interpretation and enforcement of this arbitration agreement.
b. Venue & Fees. Arbitration will occur in the county of your residence or another mutually agreeable location, or by telephone/video or on written submissions, as allowed by AAA rules. AAA rules will govern payment of filing, administration, and arbitrator fees.
c. Class-Action Waiver. You and we agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative or class proceeding.
d. Opt-Out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending a written notice with your name, address, phone, and email to contact@perseusloans.com (subject line: “Arbitration Opt-Out”) or by mail to the address we provide on request. Opting out will not affect other Terms.
16. Governing Law; Venue
These Terms are governed by the laws of the State of Arizona, without regard to its conflicts of law rules, and the FAA for arbitration issues. Except for claims in small-claims court or arbitration, the state and federal courts located in Arizona have exclusive jurisdiction. You consent to personal jurisdiction and venue in those courts.
17. Changes to the Site or Terms
We may update the Site and these Terms at any time. The “Last Updated” date above reflects the latest changes. Your continued use of the Site after changes become effective constitutes your acceptance of the revised Terms.
18. Termination
We may suspend or terminate your access to the Site at any time for any reason, including violations of these Terms. Upon termination, Sections 6, 10–16, 18, and 19 will survive.
19. Miscellaneous
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
- Entire Agreement. These Terms, together with the Privacy Policy and any disclosures or consents presented via the Site, are the entire agreement between you and us regarding the Site.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
- No Waiver. Our failure to enforce any provision is not a waiver of our rights.
- Force Majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
